<p> The year was 1961.  John F. Kennedy and the era of Camelot that accompanied his presidency had a nation believing in possibilities.  He encouraged a country to see hope and promise; he pledged to put a man on the moon and to “return him safely back to earth.”  Yet, despite President Kennedy’s boyish good looks and ruddy complexion, the photos showing him sailing and playing touch football at his family’s Massachusetts compound, Hyannis Port, America’s Chief Executive had a secret.  President Kennedy suffered from Addison’s disease – chronic adrenal insufficiency, says Frank N. Darras, America’s top ERISA lawyer.</p>

<p>According to Darras, founding partner of DarrasLaw, “It is perhaps President Kennedy’s condition, his immune system abnormalities that led him to create the President’s Committee on Corporate Pension Plans, forerunner to ERISA, Employee Retirement Income Security Act” (signed into law on September 2, 1974 by Gerald R. Ford).  “Realizing that he was privileged to have superior insurance, President Kennedy saw his Presidential Committee as a way to better serve people, something ERISA was intended to do, each and every day.”</p>
<p>&#13;</p>
<p>Frank N. Darras, nationally recognized as the top long term disability insurance lawyer in America, is famous for fighting for those too weak or too ill to take on big insurance.  Darras says there are a number of ERISA Civil Violations the public needs to be aware of including:&#13;<br />
</p>
<p>&#13;<br />
     Failing to operate the plan prudently and for the exclusive benefit of the participants.&#13;<br />
     Using plan assets to benefit related parties to the plan, including the plan      administrator and plan sponsor.&#13;<br />
     Failing to properly value plan assets at their current fair market value, or to hold plan assets in trust.&#13;<br />
     Failing to follow the terms of the plan (unless inconsistent with ERISA).&#13;<br />
     Failing to properly select and monitor service providers.&#13;<br />
     Taking adverse action against an individual for exercising his/her rights under the  plan, e.g., being fired, fined or discriminated against.
<p>The most egregious, is my final point listed, says Darras.  Taking adverse action against an individual for exercising his/her rights under the plan.  “Plan complexities and employee feelings of powerlessness,” are two of the many reasons he and his firm of ERISA lawyers advocate on behalf of their clients.  He concludes, “Just as President Kennedy understood the pluses and pitfalls of insurance, advocating new initiatives to protect the rights of all, so too, does DarrasLaw understand ERISA complexity and how to help ERISA claimants.”</p>

<p>On February 9th, 2012, the Department of Health and Human Services, Labor, and Treasury provided their final regulations implementing section 2715 of the Public Health Services Act, a provision of the Affordable Care Act. This ruling changes the way employers and insurance providers must disclose fees and outline services under ERISA (Employee Retirement Income Security Act).  The long-awaited ruling is a welcome change for many who have been wrongfully denied coverage under ERISA.</p>

Rittenmeyer has more than 25 years of experience in the food protection field, having served as Director of Safety Management Services at FoodHandler Inc. from 1999 through 2010. Prior to FoodHandler, Rittenmeyer was employed by the State of Iowa, Iowa Department of Inspections and Appeals as the Training Officer for the Food and Consumer Safety Bureau for 13 years. </p>

<p>Rittenmeyer is currently a certified master instructor with the Educational Foundation of the National Restaurant Association and has conducted, among others, ServSafe classes for Iowa State University and the Iowa Department of Education via the Iowa Communication Network (ICN). Rittenmeyer has obtained instructor&#8217;s status with the Dietary Managers Association (DMA) and the National Sanitation Foundation (NSF) Food Safety Program. While employed by the State of Iowa, she was standardized by the FDA as a Food &amp; Sanitation Evaluation Officer and completed the FDA SW Region’s Level One Training Requirement. She has also achieved the National Environmental Health Association&#8217;s Certified Food Safety Professional credential. In addition, she has served on the Legislative Action Food Safety Committee of SNA (School Nutrition Association), and also served on the NRA and DMA Test Writing committees.</p>

The court denied the plan’s motion to dismiss on two grounds: (1) Plaintiffs’ claims are not barred by the two-year limitations period, (2) Defendants’ argument on the exhaustion of administrative remedies does not hold merit at this time. </p>

<p>SHERRIL A. DUNN and THOMAS A.: DUNN, individually and on behalf of all other similarly situated individuals v. HONEYWELL INTERNATIONAL, INC. and BRIAN J. MARCOTTE, Case #: 11-cv-2810, filed on January 31, 2012, in the United States District Court District Of New Jersey</p>
<p>&#13;</p>
<p>Of newsworthy and importance to all healthcare executives and attorneys are (1) the Court’s new legal reasoning on the ERISA required exhaustion of appeal remedies in order to proceed with the litigation for the plaintiffs, (2) The new trends in the out-of-network UCR denial litigations, to directly sue the self-insured health plan and the plan administrator personally by the patients under federal law ERISA, instead of only suing the insurer or TPA by providers under the state laws in the state courts.</p>
<p>&#13;</p>
<p>“While 77% of insured Americans in all employer sponsored plans paid for out-of-network (ONET) coverage, the ONET UCR claim denials and litigations are inevitably important to all employers, patients, providers and hospitals”, says Dr. Jin Zhou, President of ERISAclaim.com, a national expert on PPACA and ERISA appeals and compliance.</p>
<p>&#13;</p>
<p>“Most providers’ legal challenges in the State Court failed for the Out-of-network UCR denials before of ERISA pre-emption,” explained Dr. Zhou.</p>

<p>According to the Court document, the following is the case background:</p>
<p>&#13;</p>
<p>“This matter involves Defendants&#8217; allegedly unlawful practice of paying less for health care service reimbursements than was agreed under the terms of health care benefit plans. Plaintiffs are Sherril A. Dunn, an employee of Honeywell and a subscriber to Honeywell&#8217;s health care plan, and Thomas A. Dunn, a beneficiary under the health care plan. Defendant Honeywell is a Delaware Corporation that produces a variety consumer products and services. Defendant Marcotte is Honeywell&#8217;s Vice President of Compensation and Benefits, and the named Plan Administrator for Honeywell&#8217;s medical welfare benefit plan. ”</p>
<p>&#13;</p>
<p>In reference to the alleged “flawed and inappropriate” Ingenix UCR data base, the plaintiffs also alleged in the Court Complaint:</p>
<p>&#13;</p>
<p>“Honeywell uses information from the Ingenix databases to determine Reasonable and Customary rates for ONET claims. Ingenix includes a disclaimer with its semi-annual database updates, however, which states that &#8220;[t]he Ingenix data . .. are provided to subscribers for informational purposes only. Ingenix, Inc. disclaims any endorsements, approval or recommendation or particular uses of the data. There is neither a stated nor an implied `reasonable and customary charge&#8217; (either actual or derived).&#8221; According to the Complaint, Defendants have been aware of this disclaimer throughout the relevant period, but used the information to determine Reasonable and Customary rates regardless, and did not disclose the substance or existence of this disclaimer to the Honeywell plan participants.”</p>
<p>&#13;</p>
<p>Critically important to the Plaintiffs in litigation, and new from this ERISA Class Action, the Court decided on appeal remedy requirements in favor of the Plaintiffs:</p>
<p>&#13;</p>
<p>“The Complaint additionally asserts that &#8220;[a]ccurate [Reasonable and Customary rate] determinations by Honeywell are impossible because Defendants rely solely on Ingenix&#8217;s flawed data in making health benefit reimbursement determinations, both initially and on appeal.&#8221; For this reason, Plaintiffs argue that any appeal of the denial of benefits would be futile, since Defendants would simply rely on the same flawed data and methodology a second time, bringing about the same result. Defendants take issue with this argument, countering that &#8220;[c]ontrary to Plaintiffs&#8217; assertion, the Plans do not require that the Ingenix database be used in making ONET reimbursement determinations; rather, the Plans mandate that the Plan Administrator . . . [take] into account all pertinent factors.&#8221; This seems to the Court a question of fact. At this stage of the litigation, the parties do not have benefit of discovery, and the Court is required to accept the factual allegations in the Complaint as true and construe all facts in Plaintiffs&#8217; favor. Plaintiffs have sufficiently alleged that Defendants have what amounts to a fixed policy of denying benefits, which could therefore render exhaustion of administrative remedies futile. Defendants&#8217; argument, therefore, does not hold merit at this time.”</p>
<p>&#13;</p>
<p>“Most providers’ UCR ERISA class action lawsuits were dismissed in part for failure to exhaust appeal remedies,” says Dr. Zhou.</p>

<p> Kids treated more than 150 days after an Anterior Cruciate Ligament (ACL) injury have higher rates of other knee injuries, including medial meniscal tears, say researchers presenting at the American Orthopaedic Society for Sports Medicine’s (AOSSM) Specialty Day in San Francisco, CA.</p>
<p>&#13;</p>
<p>“In our research, children who had delayed treatment of an ACL injury more than 150 days, tended to have an increased chance of also having a medial meniscus or chondral injury in their knee. These additional injuries may increase recovery time, inhibit return to play, and worsen long term functional outcomes of the knee,” said lead researcher, Guillaume D. Dumont, MD of the University of Texas Southwestern Medical Center in Dallas, Texas.  “This finding may also be relevant when counseling patients and their families regarding timing for injury treatment.”                                                                                                                      </p>
<p>&#13;</p>
<p>The researchers analyzed records from 370 patients who underwent ACL reconstruction between January 2005 and January 2011 at Children’s Medical Center of Dallas. 200 patients were more than 15 years old and 170 patients were less than 15 years old. There were 208 male patients and 162 female patients involved in the study. Patients were injured in a variety of athletic activities: football (29.7%), basketball (20.2%), soccer (17.6%), cheerleading/gymnastics (4.3%), and other (28.1%).</p>
<p>&#13;</p>
<p>“Weight also appeared to be a factor associated with the rate of meniscal tears found at the time of surgery,” comments senior author, Philip Wilson, MD. “Our data demonstrates patient weight over 143 lbs (65 kg)  to be associated with an increased rate of  medial and lateral meniscal tears at the time of surgery. With recent significant increases in child and adolescent obesity rates, this finding may have significant public health implications.”</p>
<p>&#13;</p>
<p>The study also demonstrated a relationship of age with children more than 15 years old having a higher rate of medial femoral chondral injury. Neither gender nor sport played during injury was found to be associated with an increased rate of injury in the study. </p>

<p>The American Orthopaedic Society for Sports Medicine (AOSSM) is a world leader in sports medicine education, research, communication and fellowship, and includes national and international orthopaedic sports medicine leaders. In an effort to save lives and promote heart healthy living, Mercy Hospital St. Louis will host its annual free Heart to Heart Fair, a community event which offers free heart health screenings, lively stage demonstrations, one-on-one consultations with Mercy healthcare professionals and more. The event will take place from 8 am to 1 pm on Friday, Feb. 24 and from 10 am to 3 pm on Saturday, Feb. 25 at West County Center, the mall located at I-270 and Manchester Road in Des Peres. </p>

<p>Taking place in front of Macy’s at West County Center, fair attendees will receive on-the-spot heart health screenings and follow up counseling with Mercy healthcare professionals. There will also be informational booths on a number of health related topics, including smoking cessation; stroke prevention; prescription drug interactions; nutrition and more. Additional exhibitors in front of Nordstrom at West County Center include Walmart, Damar Travel, Chefs in the Making, Title Boxing, Les Bouquets, American Heart Association, Sudden Cardiac Arrest Association, Laumeier Sculpture Park and others providing information, special offers and free samples. Throughout each day there will be presentations, giveaways, interactive fitness activities, food samplings and cooking demonstrations on the Heart to Heart Stage.  </p>

<br />Anyone age 21 and over is encouraged to attend the Heart to Heart Fair and get screened. Through a series of simple screenings, each individual will receive their “numbers,” which help the onsite health care providers quickly evaluate if a person’s heart health is in within the normal ranges. Follow up counseling will be provided with valuable information on lifestyle improvements and additional care if recommended.  Mercy cardiologists and health professionals stress the importance of understanding the risk of heart complications. </p>

<p>Contrary to the common belief that heart disease is only a “man’s disease,” it is in fact the leading cause of death for American men and women.
